Certain provisions of these terms may be superseded by expressly designated legal notices or terms located on particular pages of this Site.
USE OF SITE
You may only use our Site if you are at least 18 years of age and can enter into binding contracts (our Site is not available for use by minors). You are responsible for maintaining the secrecy of your passwords, login and account information. You will be financially accountable for all uses of our Site by you and anyone using your password and login information. You may only use our Site only for legitimate dating experience. E.         Upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

F.         Upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights (hereinafter “Rights”) of any party;

G.         Upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain mail,” “pyramid schemes,” or any other form of solicitation, except to upload advertisements in the areas that are designated for the purpose of posting advertisements;

H.         Upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

I.          Disrupt the normal flow of dialogue, cause a screen to “scroll” faster than other users of the service are able to type, or otherwise act in a manner that negatively affects other users’ ability to engage in real time exchanges;

J.         Interfere with or disrupt the service or servers or networks connected to the service, or disobey any requirements, procedures, policies or regulations of networks connected to the service;

K.         Disrupt the functioning of the service and/or the Company, or otherwise act in a way that interferes with other users’ use of the service and/or the Company;

L.         “Stalk” or otherwise harass another;

M.        Collect or store personal data about other users; or

N.         Submit, or attempt to submit, contents containing marketing or promotional material which is        intended to solicit business, without first obtaining the written authorization of the Company.

You acknowledge that the Company is not obliged to pre-screen Content, but that the Company and its designees, agents, officers, directors and employees shall have the right (but not the obligation) in their sole discretion to refuse or remove, edit, move, discard any Content that is available via the site. Without limiting the foregoing, the Company and its designees, agents, officers, directors and employees shall have the right to edit, delete, remove, discard any Content (including the Content that you have submitted) that violates this agreement or is otherwise objectionable, at its sole discretion. You understand that the technical processing and transmission of the service, including your Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

SERVICE
SAFER DATES, LLC is committed to providing a safer online dating forum known as SAFER DATES. SAFER DATES believes in proper education and honesty in providing services through its Site. SAFER DATES provides an attractive forum for individuals from different backgrounds who are looking for companionship to find a potential date for themselves. SAFER DATES shall make a reasonable and diligent attempt to conduct accurate and complete background check for its Registered Users requesting such verification. SAFER DATES may in its sole discretion deny membership to any person in order to maintain dignity and to effectively provide a safer online dating service to individuals seeking a legitimate companionship. SAFER DATES makes no claim or warranty to its Users or Registered Users for their personal safety or wellbeing. SAFER DATES encourages all Users and/or Registered Users to exercise caution while on world wide web and when contacting a Registered User in person.
SAFER DATES offers and encourages optional background checks for its Registered Users including but not limited to assessing an individual’s marital, misdemeanor, felony, sex offender status, and fingerprint analysis. Passing the different Verification Levels adequately will earn an appropriate “Verified" Registered User seal or icon on Registered User’s profile indicating that the Registered User’s background has been investigated. SAFER DATES shall reserve its right to terminate Registered User’s membership without issuing any refunds if a Registered User has any criminal record which is revealed during Registered User’s duration of membership. SAFER DATES also reserves the right to terminate a Registered User‘s membership if a Registered User is legally classified or considered to be married under any pertinent statute of any state in the territories of the United States, or is considered to be married under any Common Law Marriage, is married under common law in the U.S. or any other country, without exception to the fact that the Registered User may be separated from his/her spouse or any other condition.
SAFER DATES shall use different seals or icons on Registered User profiles to indicate Registered User’s Level of Verification. SAFER DATES makes no claim or warranty, whether expressed or implied that SAFER DATES offers the safest methodologies for checking criminal records. SAFER DATES makes no claim or warranty that the results for different Levels of Verification are accurate or 100% correct. Level of Verification seal or icon represents that SAFER DATES has made a diligent effort to conduct a reasonable background investigation.
Level I Verification: Level I Verification certification may appear on Registered User’s profile within a minimum of 72 hours after Registered User orders background investigation for such certification. For Level I Verification certification a Registered User shall provide his/her legal name(s), alias, date of birth, sex, residential address and social security number (optional). Upon reviewing such background investigation, SAFER DATES shall determine in its sole discretion, whether a Registered User may remain a member of the Site. If Registered User’s marital, misdemeanor, felony, sex offender status, and fingerprint analysis indicates unfitness for continued membership of the Site, then SAFER DATES shall immediately terminate Registered User’s membership and shall notify Registered User through an email account provided to SAFER DATES within 24 hours of such decision by SAFER DATES. In the event of such cancellation of membership account by SAFER DATES, SAFER DATES shall not refund any monies charged for Level I or Level II Verification fees. In its sole discretion, SAFER DATES may request additional information from Registered User to conduct further investigation or to get clarification on a certain matter as indicated in Registered User’s background investigation. Upon approval of Level I Verification certification, Registered User shall be notified of such approval or denial through an email address provided by Registered User to SAFER DATES. Registered User paying for Level I Verification expressly acknowledges and understands that the background investigation shall be conducted on an annual basis. A reminder email may be sent by SAFER DATES of such renewal 30 days prior to conducting such background investigation for Level I Verification. Registered User shall warrant and represent by accepting these Terms that Registered User has continuing obligation to report and inform SAFER DATES of Registered User’s marital, misdemeanor, felony, and/or sex offender status during the membership period covering that certain timeframe in which SAFER DATES has certified Registered User under its Level I Verification. SAFER DATES shall not be responsible for any resulting harm or damages as a result of Registered User’s misrepresentations, omissions and/or failure to disclose any information which may disqualify such Registered User to be certified under Level I Verification. SAFER DATES shall not release any background investigation information compiled by SAFER DATES, unless SAFER DATES cancels Registered User’s membership. Please Note: If we do a background search and anything that does not meet our standards is found at the time the search is conducted, your membership will be canceled and no refunds will be issued whatsoever.
Level II Verification: Level II Verification certification may appear on Registered User’s profile within a minimum of 16-18 weeks timeframe after Registered User orders background investigation for such certification. Registered User’s credit or debit card shall not be charged upon selecting Level II Verification certification. Registered User should click on Level II icon on the Site to obtain list of instructions and forms to apply for Level II Verification certification. At Registered User’s email request at customerservice@saferdates.com, SAFER DATES customer service representative will contact the Registered User through Registered User’s email address, and provide Registered User with details regarding the documentation required to complete the Level II Verification certification, and to obtain the Federal Bureau of Investigation Identification Record. Registered User expressly acknowledges and understands that the Registered User shall co-operate with SAFER DATES in completing and submitting any and all documentation as required by Federal Bureau of Investigation – Criminal Justice Information Services Division pursuant to Title 28 Code of Federal Regulations Part 16. Registered User shall execute Release of Information Form, which must also be notarized. Registered User shall also sign a form cover letter to Federal Bureau of Investigation – Criminal Justice Information Services Division, requesting Registered User’s aforementioned Identification Record. Registered User must also obtain a proof of identity, which shall consist of Registered User’s fingerprints with Registered User’s name, date of birth and place of birth. Fingerprints shall only be accepted if fingerprints are placed on a standard fingerprint form (FD-258), used for law enforcement purposes. Previously processed fingerprint cards shall not be accepted. Registered User must obtain his/her fingerprints from a law enforcement agency, which provides fingerprint technician services. Registered User shall send a certified or money order in the amount of $39.95 payable to SAFER DATES, LLC at 2198 N.E. Coachman Road # 164, Clearwater, Florida 33765. SAFER DATES shall compile all the documents for Registered User and shall dispatch such information to Federal Bureau of Investigation – Criminal Justice Information Services Division. SAFER DATES shall then forward all documentation to Federal Bureau of Investigation – Criminal Justice Information Services Division, 1000 Custer Hollow Road, Clarksburg, West Virginia 26306. Upon receipt of Registered User’s Federal Bureau of Investigation Identification Record, SAFER DATES shall review the background information and either certify the Registered User’s profile as Level II Verification or deny such certification status. In the event, SAFER DATE denies Level II Verification certification for the Registered User, then the Registered User may request a copy of Registered User’s Federal Bureau of Investigation Identification Record with a written request which must be sent through certified mail, return receipt requested to SAFER DATES,LLC at 1548 South Missouri Ave Suite 200 Clearwater, Fl 33756, within 180 days of notice from SAFER DATES to Registered User indicating denial of Level II Verification certification. In the event, that the Registered User requests a copy of the Registered User’s record received from the Federal Bureau of Investigation the request must accompany a check or money order for a $50 administrative fee along with a $14.95 fee for shipping and handling plus any other costs or fees in association with such request payable to SAFER DATES, LLC. Payments must be directly mailed to 1548 South Missouri Ave Suite 200 Clearwater, Fl 33756. SAFER DATES shall destroy all original copies of Registered User’s Federal Bureau of Investigation Identification Record. Duplicate copies of such records may be kept by SAFER DATES to provide for the purpose of providing renewal of Level II Verification certification and other related future services to the Registered User. Registered User shall expressly acknowledge and agree that Registered User grants permission to SAFER DATES, LLC to review and to have unrestricted access to any and all confidential information including but not limited to Registered User’s Federal Bureau of Investigation Identification Record. Registered User further acknowledges and understands that any and all information of Registered User relating to Registered User’s Federal Bureau of Investigation Identification Record shall be kept strictly confidential by SAFER DATES. If applicable, Registered User by accepting this Agreement fully authorizes SAFER DATES to make a decision to approve or deny Registered User‘s Level II Verification certification at its sole and absolute discretion. Under no circumstances will SAFER DATES release any of Registered User’s Federal Bureau of Investigation Identification Record information to anyone other than Registered User and to employees and agents of SAFER DATES. Registered User expressly warrants and represents the acceptance of this Agreement shall constitute Registered User’s permission that Registered User’s Federal Bureau of Investigation Identification Record shall be mailed directly to Safer Dates, LLC at 1548 South Missouri Ave Suite 200 Clearwater, Fl 33756. Registered User may challenge his/her information as contained in Federal Bureau of Investigation Identification Record by contacting either Federal Bureau of Investigation – Criminal Justice Information Services Division, 1000 Custer Hollow Road, Clarksburg, West Virginia 26306, or the original agency that submitted the information to Federal Bureau of Investigation or the state central repository in the state where the arrest occurred. Such agencies may be able to furnish the guidelines for correction of any error in Registered User’s Federal Bureau of Investigation Identification Record. Please be advised that SAFER DATES is not authorized to modify Federal Bureau of Investigation Identification Record nor shall SAFER DATES assist in correction or be liable any expense involved in correction of such errors on Registered User’s Federal Bureau of Investigation Identification Record. Please Note: If we do a background search and anything that does not meet our standards is found at the time the search is conducted, your membership will be canceled.
InvestiDATE: InvestiDATE gives Users the opportunity to put an individual of your choice through the Level I Verification screening. This individual will be screened through national databases for marriage records, sex offender status, felonies, and misdemeanors. In order to obtain Level I Verification screening results Users must provide individual’s full name (first and last), birthday and current address. It is preferable that social security number be provided, however it is not mandatory. SAFER DATES will email the results to Users within 24-72 hours, however actual response time may vary. Users will receive a pass or fail indication. Specific criteria for failure shall not be disclosed. SAFER DATES makes no claim or warranty that the results for different Levels of Verification are accurate or 100% correct. Level I Verification screening results represent that SAFER DATES has made a diligent effort to conduct a reasonable background investigation.
Reputation Share: Saferdates.com leverages ReputationShare, an online reputation service that identifies both positive and negative online behavior. This functionality allows us to reward great members and manage negative behavior that violates our site’s terms of use. ReputationShare does not know who you are; it does not receive, maintain, share, or store any personally identifiable information. Your identity with ReputationShare is based on an encrypted numerical abstraction. ReputationShare operates in compliance with the Children's Online Privacy Protection Act of 1998, as it does not collect or use email addresses or other personal information from anyone, including children under 13 years of age.

Affiliate shall be paid by SAFER DATES every calendar month on the 1st day. You must earn at least $100.00 to get paid for a calendar month. If you earn an amount under $100.00 in any calendar month then you will not be paid by SAFER DATES. SAFER DATES IN ITS SOLE DISCRETION MAY CANCEL AN ACCOUNT OF ANY INDIVIDUAL WHO HAS SIGNED UP IN THE AFFILIATE PROGRAM. ANY INDIVIDUAL WHO CREATES MORE THAN ONE ACCOUNT SHALL NOT BE ELIGIBLE TO SIGN UP AGAIN UNDER THE SITE’S AFFILIATE PROGRAM AND SAFER DATES SHALL IMMEDIATELY TERMINATE ANY AND ALL ACCOUNTS OF SUCH INDIVIDUAL ON THE SITE AND NO COMMISSION SHALL BE PAID.
Blog: SAFER DATES TAKES NO RESPONSIBILITY FOR ANY COMMUNICATIONS BETWEEN USERS OR POSTED BY ANY USER. USER ACKNOWLEDGES AND AGREES THAT USER’S PARTICIPATION IN AND ON THE SITE IS AT ITS OWN RISK. Other Services: You understand and agree that the service may include certain communications from SAFER DATES, such as service announcements, administrative messages and the SAFER DATES Newsletter, and that these communications are considered part of your SAFER DATES membership account, without offering you the opportunity to opt-out of receiving them. Unless explicitly stated otherwise, any new features that augment or enhance the current services, shall be subject to the terms and conditions in this agreement. You understand and agree that the Service is provided “AS-IS” and that SAFER DATES assumes no responsibility for the timeliness, deletion, misdelivery or failure to store any user communications or personalization settings. You are responsible for obtaining access to the service and that access may involve third party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the service.
MEMBERSHIP FEES
Registered Users can sign up for membership to the Site and use the services of the Site for membership cost, except for costs relating to upgrades including Level I Verification and/or Level II Verification or other paid services on the Site. Registered Users can view other profiles, email other members, chat live with other members, and view other member’s assessment responses. Users and Registered Users expressly agree and acknowledge that there are no refunds for the services provided on the Site in connection with membership cost. Registered Users can sign up for a FREE limited access membership except for costs relating to upgrades including Level I Verification and/or Level II Verification or other paid services/memberships on the Site.
All Registered Users who upgrade to a Level I Verification shall be automatically charged an annual “renewal fee” of $19.95 for Level I Verification certification every twelve (12) months from their initial membership of Level I Verification unless Level I Verification was inactivated by the Registered User or by SAFER DATES. You must give a 30 day written notice of your intent to cancel your Level I Verification or you agree to be billed for another (12) months of Level I Verification. The fee to obtain a Level II Verification certification is $39.95 for every twelve (12) months as stated hereinabove and Registered User must complete the application process and pay the fees every twelve (12) months to renew Level II Verification certification.
OWNERSHIP
We own and have copyrights on our Site, and all of its content. You will not copy, reproduce, republish, upload, post, transmit, distribute, sell, transfer or modify any of the content, data, information or materials found on our sites, and may not be copied, reproduced, modified, published, uploaded, posted, transmitted, or distributed in any way, without SAFER DATES’ prior written permission. Trademarks, logos and service marks displayed on our sites ("Marks") are our registered and common law Marks. Your use of and access to our Site does not grant you any license or right to use any of these Marks not otherwise stated herein. You will not use any robot, spider, other automatic device, or manual process to monitor services available through our Site.
SINGLE COPY LICENSE
You acknowledge and agree that the service and any necessary software used in connection with the service (“Software”) contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as otherwise indicated on this Site, you may use one copy of the information or Software (“Materials”) found on this Site on a single computer for your personal, non-commercial, internal use only unless specifically licensed to do otherwise by SAFER DATES in writing or as allowed by any license terms which accompany or are provided with individual Materials. You agree not to modify the Software in any manner or form, or to use any modified versions of the Software, including, without limitation, for the purpose of obtaining unauthorized access to the service. You agree not to access the service by any means other than through the interface that is provided by SAFER DATES for use in accessing the service. SAFER DATES does not make any endorsements of Materials found or posted on the site.
NO RESALE OF SERVICE
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the service, use of the service, or access to the service.
TRADEMARK INFORMATION
All brand, product, service, and process names appearing on this Site are trademarks of their respective holders, and SAFER DATES does not make any endorsements of such trademarks of their respective holders, that appear on this Site. SAFER DATES’s trademarks may be used publicly with written permission only from SAFER DATES. Fair use of SAFER DATES’ trademarks in advertising and promotions of SAFER DATES products requires proper acknowledgement. Reference to or use of a product, service, or process does not imply endorsement, recommendation, approval, affiliation, or sponsorship of that product, service, or process by SAFER DATES.
You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws.
YOUR REGISTRATION OBLIGATIONS
In consideration of your use of the online dating service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the SAFER DATE’s Member Registration form (such information being the “Member Profile Data”) and (b) maintain and promptly update the Member Profile Data to keep it true, accurate, current and complete. If applicable, any and all information provided to SAFER DATES by Registered User shall be used for Registered User’s background investigation(s). If you provide any information that is untrue, inaccurate, not current or incomplete, or SAFER DATES has reasonable grounds to believe that such information is untrue, inaccurate, not current or incomplete, SAFER DATES shall reserve its right to suspend or terminate your membership and refuse any and all current or future use of the Site (or any portion thereof).
MEMBER ACCOUNT, PASSWORD AND SECURITY
You are required to enter your member name, email and password as part of completing SAFER DATES’s Member Registration process. You are responsible for maintaining your member account details. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify SAFER DATES of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you will properly log off from the Site and close the browser session from your account at the end of each session. As a Registered Users of SAFER DATES you agree to abide by the following Code of Conduct and failure to abide by this Code of Conduct shall authorize SAFER DATES to terminate Registered User’s service at its sole discretion without any written warning.
You, as Registered User attest that:
I agree to be truthful both on my profile and on any and all questionnaires that I complete on the Site.
I agree that I will not use harassing, vulgar or otherwise offensive language towards other Registered Users.
I agree that I will not utilize the chat rooms on the site to stalk, intimidate, or otherwise harass other Registered Users.
All personal photos of Registered Users shall be no more than 2 years old.
I agree to not post any pictures of minors and or children.
I agree that I am single and looking for companionship (in person or online).
I agree to inform SAFER DATES of any change in my marital status, criminal record status, and sex offender status in writing within 30 days of such change.
I agree to uphold this Code of Conduct and report regarding other Registered Users who are in violation of this Code of Conduct or this Agreement.
Registered User expressly agrees and acknowledges that failure to abide by any of the following shall authorize SAFER DATES to terminate Registered User’s service at SAFER DATES’ sole discretion without any written warning to Registered User. Registered User agrees to not use the Site to:
•    upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
harm minors in any way;
•    impersonate any person or entity, including, but not limited to, a SAFER DATES official, online discussion forum/chat room leader or system administrator, or falsely state or otherwise misrepresent your affiliation with a person or entity;
•    forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the service;
upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

•    disrupt the normal flow of dialogue, cause a screen to “scroll” faster than other users of the service are able to type, or otherwise act in a manner that negatively affects other users’ ability to engage in real time exchanges;
•    interfere with or disrupt the service or servers or networks connected to the service, or disobey any requirements, procedures, policies or regulations of networks connected to the service;
•    disrupt the functioning of the service and/or SAFER DATES , or otherwise act in a way that interferes with other users’ use of the service and/or SAFER DATES;
•    “stalk” or otherwise harass another; or
•    collect or store personal data about other users.

NOTICES AND SITE ADMINISTRATION UPDATES

TERMINATION OF SERVICE

In the case of suspension or termination of access and/or service, SAFER DATES is not obliged to refund to you any fees for the remaining period of subscription after termination.
In the event Registered User’s membership is terminated due to the results of the background investigation or if an applicant or a User is denied membership due to unfitness for membership based on marital, misdemeanor, felony, or sex offender status and in the sole discretion of SAFER DATES, SAFER DATES shall not refund any monies or fees. You expressly agree and acknowledge that any cancellation of your access to the Site shall result in deactivation of your access to the Site (or applicable part thereof) and termination of all related information and files in your account and/or you will be not have any further access to such files or the Site (or applicable part thereof) at the end of your active membership period. Further, you expressly agree and acknowledge that SAFER DATES shall not be liable to you for any cancellation of your access to the Site (or applicable part thereof).
If access and/or service is suspended, but re-instated later, your subscription period will be resumed from the point of re-installation until the subscription period expires, after which normal subscription and charging process will apply. If access is suspended and then terminated, termination rules as described above will apply. You agree that termination of your access to the service will result in SAFER DATES to immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that SAFER DATES shall not be liable to you or any third-party for any suspension or termination of your access to the service.
CANCELLATION OF SERVICE
You have the option to cancel your subscription to the service (or any part thereof) at any time. When you cancel you will receive an email confirmation of the same within 72 hours. After the last day of your subscription period you will immediately destroy the materials and all licenses herein related to the service (or applicable part thereof) shall immediately terminate. You agree that SAFER DATES will not refund any fees upon such cancellation of service.
DELETING MEMBERSHIP
You may remove yourself as a member of SAFER DATES at any time. When you contact us to delete your membership, you will receive an email confirmation of the same within 72 hours. You understand that your request for deleting membership will be treated with the same rules that apply to Termination of Service described above, with the exception of SAFER DATES providing notice within 24 hours-this is superseded by SAFER DATES’s email confirmation sent within 72 hours as described in this provision.
MODIFICATIONS TO SERVICE
SAFER DATES reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice, and without liability. You agree that SAFER DATES shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the service. Treatment of Suspension of service is described above in section ‘Termination of Service’. Treatment of Discontinuance of Service is the same as that described above for Cancellation of Service above.
INDEMNIFICATION
YOU HEREBY AGREE, AT YOUR OWN EXPENSE, TO INDEMNIFY, DEFEND AND HOLD SAFER DATES (AND ITS DESIGNEES, AGENTS, OFFICERS, DIRECTORS AND EMPLOYEES) HARMLESS FROM AND AGAINST ANY LOSS, COST, DAMAGE, LIABILITY, OR EXPENSE ARISING OUT OF OR RELATING TO ANY THIRD-PARTY CLAIM, ACTION, DEMAND OR ALLEGATION BROUGHT AGAINST SAFER DATES BASED UPON OR RELATING TO, DUE TO OR ARISING OUT OF (A) A DISPUTE BETWEEN YOU AND A VENDOR OR A USER (REGISTERED OR OTHERWISE) OVER THE TERMS AND CONDITIONS OF A CONTRACT OR RELATED TO THE PURCHASE AND SALE OF ANY GOODS/SERVICES, (B) A BREACH BY YOU OF THE TERMS AND CONDITIONS OF THIS AGREEMENT, (C) ANY ACTION OF YOU OR A VENDOR OR A USER (REGISTERED OR OTHERWISE) WHICH VIOLATES ANY LAW, REGULATION OR RIGHTS OF A THIRD PARTY, OR (D) CONTENT YOU SUBMIT, POST, TRANSMIT OR MAKE AVAILABLE THROUGH THE SERVICE, YOUR USE OF THE SERVICE, YOUR CONNECTION TO THE SERVICE, YOUR VIOLATION OF THE AGREEMENT, OR YOUR VIOLATION OF ANY RIGHTS OF ANOTHER.
DISCLAIMER OF WARRANTIES

YOU ARE WHOLLY RESPONSIBLE FOR ALL ACTIVITIES CONDUCTED THROUGH YOUR ACCOUNT IN ACCESING THE SITE. IN NO WAY WILL SAFER DATES BE LIABLE FOR ANY LEGAL ACTIONS BROUGHT AGAINST YOU BY SUCH VENDORS OR USERS (REGISTERED OR OTHERWISE).
GENERAL
THIS AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF FLORIDA, U.S.A., WITHOUT REGARD TO ITS RULES GOVERNING CONFLICTS OF LAW. THE PARTIES AGREE THAT THE EXCLUSIVE VENUE FOR ALL ACTIONS AND ARBITRATIONS RELATING IN ANY MANNER TO THIS AGREEMENT SHALL ONLY BE IN A FEDERAL OR STATE COURT OF COMPETENT JURISDICTION LOCATED IN FLORIDA, U.S.A. If any provision of this Agreement is for any reason held unenforceable or invalid, then this Agreement shall be construed as if such provision were not contained in this Agreement. Any disputes between the parties hereto whether arising under these Terms and Conditions or otherwise which the parties cannot resolve between themselves in good faith shall be referred to a mediator residing in Pinellas County, Florida, and any mediation shall be held in Pinellas County, Florida. You will bear the cost of said mediation. Mediation shall be in accordance with the procedures of the American Arbitration Association (hereinafter “AAA”). If for any reason said dispute is not resolved by mediation within thirty days, the parties shall submit the dispute to a neutral arbitrator residing in Pinellas County, Florida. Should the parties fail to agree on one arbitrator, they shall submit their dispute to a panel of three arbitrators.
